Please read carefully the terms & conditions mentioned below. We make every efforts to provide you with the best services in a pleasant & friendly atmosphere at all times. We strive for  your complete  satisfaction to  provide a safe & secure Journey without any misunderstandings between the tour excorts, the company,& you at any time. Your are required to read, understand properly and accept all the terms & conditions before the tour.

DEFINATION
“ Passenger/s / you/ Guest/ Client/ Traveller/Touriest/ means the persons in whose name / on whose behalf booking or registration  is made.
“Company /We/us/ KMC Holidays & Offshore Pvt. Ltd.
Tour means trip , holidays so journey prepared by KMC , which includes group, tours, individuals tours,FIT  packages, incentive tours, conference tour ect. Both these terms ca be used interchangeably.
“Independent Contractors” means any hotelier / hotel owner, or Bus, Car supplier or Railway or Ferry boat/ cruise/ ship/ coach owner/ operator or any other person or organization  who has been selected the company to render services to the passenger(s) & who has agreed to render service to the company.
“ Tour Escort/ tour Leader// Tour Manager / Tour Assistant  means person( s) who guides / assist tourist on  tour/ trips or guide with information about tourist attractions unless the context otherwise requires words, importing the masculine gender, shall also include femi gender and vice versa.

SCOPE OF ACTIVITY
We are basically travel and holiday organization only.  We do not own, operate or any airline  or any other mode of transport , like shipping , railway, motor car , buses, coaches etc. or any hotel or restaurant , other facility or services mentioned in this brochure. We take almost care in selecting all the ingredients for making your holiday a comfortable one. Thus we are not liable and responsible for any injury, loss, personal harm, death or damage that may be caused to any person or property which may be caused by the act or default of the management or employees of any independent contractor and arising outside  our normal selection and inspection process and also in between the tour journey.
It is imperative that all the passengers who  book with us with an intention with us shall abide by and strictly comply and observe all the terms & conditions laid down herein.

BROCHURE  ACCURACY
We reserve the right to change any brochure information before or after  a tour is booked, due to occurrence of any events beyond our control. Tour itinerary, tour price , departure date and hotels are subject to change . If we are aware of these changes sufficiently beforehand, we will inform you  in advance otherwise , our tour escort or local representative will inform  you of the changes on tour.
SIGNATURE & COMPLETION OF THE FORMALITIES AT THE TIME OF BOOKING.
Guest’s  signature on the registration form or payment of the initial registration amount whichever earlier shall means. Acceptance in totality of the ‘Terms and Conditions’ contained herein by the guest(s). In case of one or more , but not all guest( s) signing the ‘Booking Form,’ it shall be deemed that the other have duly authorized the concerned signing passenger/s and everybody shall be deemed to have been bound by the terms and condition mentioned herein
There shall not  arise any contract between the company and guest(s) until the company receives the initial tour registration amount as per the procedures in the brochure. The initial deposit just ensures a  seat or participation on the tour but does not entitle any of the services such as  air tickets, hotel accommodations
&  other s until the full tour payment has been received by the company. The full payment must be received in accordance with the procedure laid down in this brochure.If full payment is not paid in time , the company reserves the right to cancel the booking with subsequent loss  of deposit & apply the cancellation charges, or post pond the to next tour after cancellation charges as mentioned herein.
TRAVEL DOCUMENT
It shall be solely the responsibility   of the  guest to hold  valid travel documents and statutory clearance , such as , passports, visas, confirmed air/ rail tickets, insurance  and medical  insurance certificate, any other document used to confirm an arrangement with service provider and other statutory certificates, to enable him/her to travel on tour  this is applicable to  NRI.
MEDICALLY UNFIT GUEST.
If any guest is suffering from any serious kind of medical ailment, which may be concern to some or all co-passengers traveling on  a group tour, then the Company reserves full right to restrict that particular guest from traveling.  The Guest has to declare any other disease which may not directly cause  any harm to other passenger.

Future Tours Guest should book their Tour  one week before.
Future Tours Guest’s Tour booking will be confirm after full payment of tour cost & if   paid by cheque  than it will confirm  after
    cheque will pass.
Future Tours Tour booking amount will accept by cross cheque only which will on the name of ___________________________________________________  A/c No- ______________________

Bank- _______________________________________________
Future Tours Cash accept  before five days of tour, against  of out authorized company’s receipt.

PAYMENT
The registration amount paid at the time of booking  is  non refundable and interest free amount. All the payment shall be paid in accordance with the procedure laid down in the form/ broauchers  under the heading
‘ How to book your tour’. The bookings will be processed only after the registration amount  is paid in full. If guests fails to pay the final payment , as per the instructions in  the form, we reserve the right to cancel the reservation. In case of billing errors, we reserve the right to reinvoice  with correct pricing. In case of dishonored  cheques, passengers will have to pay INR Rs:- 500/- for every such dishonor . A  cheque dishonored is an offence under the negotiable instrument Act 1881 and the Company  reserves its rights to take necessary legal action as may be advised. In case the guest is booking the tour within  10 days  of the departure ( Subject to availability)  will have to make all the payments by demand draft or cash ( as per th tour). In this case cheques are not accepted.
TOUR  PRICE
The price of the tour quoted in our proposal or  brochure has been calculated as per the rates prevailing at the   time of printing of such proposal or  brochure. The company  reserves the right to amend / after the price published in such proposal or brochure  in case of supplier rates fluctuations, currency fluctuations due to changes in the various cross rates of exchange, charges in various taxes / or fuel cost before the date  of departure. Any such  increase in price must be paid for in fill before tour departure by the guest. In such exceptional cases any increase in price during the  tour must be paid in full by the guest during tour.All tour prices are exclusive of service tax, any other government taxes applicable from time to time. Tour dates & tour  programme as well as  number of day published in the leaflets or in brochure are subject to change.
PASSPORT – (APLICABLE FOR NRI)
Passport is an official document any identity of person/guest as a citizen, issued by that particular country’s  government which is required for NRI/ Non  Indian guest to travel. For Non- Indian Guest passport is fully their responsibility & not us.
GOVERNMENT RULES FOR NRI ( Non resident Indian travelers)
For the security reasons government of India has revised the rules  of the NRI’s to visit India . All guest’s/ tourist staying abroad or are NRI’s or Foreigners should  ensure all the conditions of current regulations laid down by government of India or any country they  are visiting.  KMC HOLIDAYS & OFFSHORE PVT. LTD. Is not responsible for any such change in rules by the  Government of India. Due to any sudden changes by the government  , if  guest needs to cancel the tour  KMC will not refund  the tour cost.
DEVIATION
If any guest want to deviate from the  tour itinerary , the charges will be made subject to availability. For such deviation , the guest has to pay the additional supplementary cost in full before the tour departure , which may affect the guest’s tour price.
JOINING   LEAVING  GUEST’S
If guests are reaching before the scheduled arrival time at the railway station  then guest’s are requested to wait at the railway station where the group is  join on day one of the tour.

If  \guests are reaching after the scheduled arrival time of the group, then guests are requested  to join the group directly at  where the group will be reach on their own means on their  charges. Company  will not responsible for it. As well as such expenses is not included in the tour price.

IDENTIFICATION
All Guests are requested to carry the photo identification in the form of driving license /election ID  card/ Pan card/ and for students their school / college ID  Card.
ITINERARY CHANGES AN UNAVAILIBILY OF SIGHTS/ PLACES.
All itinerary are well planned. These itineraries are based on certain ingredients like, airline, ship, boat, coach, car, bus or train,. In case of the changes in these schedules itineraries will have the impact of the same. Accordingly the company   reserves the right to change its schedule due to circumstances beyond its control. Such changes shall also cause variation by way of alternations/ additions in the tour programme/ on tour price. For the comfort and convenience of guests or to meet the requirements of emergencies or to face the unavoidable circumstances , we may sometimes change the direction, or slightly  amend  the itinerary, including  train/ car/ coach routing. The said changes shall be intimated to you prior to the  start of the tour or on tour , if such alteration need any additional  payment to be made then it will be collected from the guest on tour itself. In the event that a passenger/ joining  passenger misses out on anypart of the sightseeing tour or any such tour due to delay on his / her part  , he/she will not be entitled to claim  refund for the  same. During local or national holidays certain  facilities such as museums, restaurants, sightseeing tours, shopping time  may be limited or not available  for which there shall be no complaints/ compensations and / or claiming or refunds
MEALS
There is pre-set  menu for meals as per the tour programme .packed meals would be served at some places. The type of meal s are clearly indicated in the broachers.
We  however , reserve the right to change the meal arrangements if circumstances make it necessary for us to do so . in the event of the guest missing any meal due to any reason, no claim can be made by the guest thereafter , for the meal he/ she has missed and not utilized.
TOUR COACHES / BUSES
We hire air conditioned / air cooled , Non-AC coaches, mini coaches, depending on the type of the tour, itinerary and passengers  strength.
PREMIUM SEATS
Seats are booked as per the booking which comes earlier.
CANCELLATION
Once the tour booked than guest can not cancel  it due to any type of reason, and company will not refund the tour cost.  Because of  any type of reason tour can no be cancel by guest , it can be postpone, for this guest shall make application to our office before  four days of tour date.
For tour postpone company will charge for extra in tour cost.
BINDING ON PASSENGERS
In the  event of the company exercising , its rights to amend or alter any of the services as mentioned in the itinerary , after  such a tour  or holiday has been booked the  guest(s) agrees to co-operate with the company’s decision and shall accept the amendments / alterations or accept any alternative tour or holiday, which the company may offer.  In either case, the guest shall not be held  entitled to, or the company shall not be liable for any damages , additional  expenses   or any consequential losses suffered by him/ her or to pay any amount as refund.
LIABILITY & RESPONSIBILY
Company is not liable for any loss of person or property caused or damage or suffered by the guest on account of deficiency in services by any independent contractor. .Any gesture of courtesy extended by the company of the passenger to minimize such loss or damage will not constitute  on admission of such liability or a waiver. To  hold Company harmless and indemnity the company shall in no circumstances whatsoever  be liable to the guest or any other person  traveling for any loss or expenses incurred due to

A. company shall not responsible for any guest security on tour’s sightseen , beaches , journey , or any anything else.

B. The company shall not be responsible  if any guest’s baggage, cash, Jewellary, or any other valuable(s) Is lost due to theft or by any other reason whatsoever during the tour . Entire responsibility of taking Care of  their valuables shall lie on the guests.

C. On tour guest should take themselves and their children’s responsibility  own, company will not Take any kind of responsibility.

D. Any sightseeing missed and / or the program being curtailed after commencement of the tour and / or before the due period due to any unavoidable circumstances and any reason, beyond our control such as  political, natural calamity, monument under renovation, VIP movement & security, heavy resh at sightseeing places, road traffic, congestion etc.

E. All the loss or expenses will have  to be born by the guest, arising in any way out of this contract in respect of any tour, holiday, excursion facility which exceeds the   total amount paid or agreed to be paid for the tour and shall in no case include any consequential loss or additional expenses whatsoever.

F. The Company shall not be responsible for any loss of baggage by the independent  contractor or their agents, hotel staff, bus/coach o while traveling etc. The company shall not be responsible and/ or liable for any damage or loss, caused to the guest(s) .The company is not liable for any loss due to negligence or technical fault or any other reason, whatsoever due to change amendment or cancellation   by Railway Authority.

G. In case of death , sickness while on tour , will have to b tackled and handled by the guest’s or their relatives, friends  themselves.

JURIDICTION
All disputes , will be subject to jurisdiction of Vasai court only
PRIVACY OF INFORMATION
We treat all information furnished by guest as confidential and will share only the necessary information with other guest, hotels, & service providers who will provide services to you on tour.
PHOTOGRAPHS OR VIDEO CLIPS
Photographs / video Clips of Guests taken on tour or sent by guests or any other purpose will used for promotion  purpose by KMC , without asking for the permission and KMC reserves the rights to use such photographs.
CONFIRMATION OF TOUR.
Every  tourist’s  Tour will be confirmed when  their tour cost comes in our Company’s  Account only.If any tourist book tour from our any agent/ franchise  than tour cost’s full responsibility will be agent’s/ franchise’s only not  company’s, till tour cost clear to our company’s account. Tour cost should come to our company’s account before  5 days, than only tourist tour will be confirmed. Tour confirmation  information call/ sms/ e-mail will come by company’s  numbers only.
